Vaccine Mandates for US Employers

After being interviewed by many newspapers and television stations, I decided it is important to publish an article about the general legal issues of employee vaccinations for Covid in the United States and particularly California. The law is simple: vaccine exemptions may exist for a sincere religious belief or due to a medical condition making vaccination dangerous to one’s health.

The however to the exemptions is the exemption cannot create an undue hardshup to the employer. For a variety of resons employes may succeed in proving undue hardship. Customers and employees will not want to work with unvaccinated employees. If proof of vaccination is rquired for entry into other businesses the employee perhaps cannot perform a major function of their job. The costs of employee sickness due to lack of vaccination are severe and so are health insurance premiums. There are too many arguments on undue hardship to win. The fact finders are not going to be sympathetic.

There are specific vaccine mandates for government employees and employee in companies where there are more than 100 employees.

Bottom line, get vaccinated, do your job, bring life back to normal.
